When voters in Portage head to the polls Tuesday for Election Day, they'll consider a controversial ballot proposal.

2,000 signatures were collected to get this measure on the ballot.

It would enact an ordinance in Portage, legalizing the possession or transfer of an ounce or less of marijuana on private property if you're 21 or older.

However, the mayor says this is all smoke and no fire.

"Will it be decriminalized for small quantities of marijuana to be used on personal property? The answer to that is no," said Peter Strazdas, Mayor of Portage.

Mayor Strazdas says state law will still trump local ordinances, and police officers in the city would still enforce current drug laws.

"The Attorney General has weighed in on this already that it will still be illegal," Strazdas said.

The signatures were collected by a group called Committee for a Safer Portage.

Supporters of the proposal say they release there are conflicts with the law.

This is more about protecting people who use medical marijuana, and their caregivers.

The mayor sees this as more of a symbolic move.

"As more cities approve this in the local ordinances it will probably send a clear message to the state legislators that they need to consider changing the state law," Strazdas said.
