Martinez - The City Council could approve on Wednesday interim ordinances regulating cultivation of recreational marijuana, ahead of the possible passage Nov. 8 of Proposition 64, which would make it legal to use pot for non-medical purposes.
City staff recommends the council pass any, or all, of three interim ordinances - one to establish a moratorium on outdoor cultivation of nonmedical pot; a second to set a moratorium on indoor cultivation of recreational marijuana, except under certain circumstances; and a third that would establish regulations for the indoor cultivation of medical marijuana.
Under Prop. 64, cities can't prohibit indoor marijuana cultivation as laid out under the proposition's language (including growing up to six living marijuana plants within a person's private residence), but cities can ban outdoor growing.The City Council voted in 2014 to ban indoor cultivation of medical marijuana.
As for growing those six nonmedical pot plants indoors, the city would create regulations for that, including that no evidence of pot growing inside a residence could be seen from public space outside of the house; indoor grow lights could not exceed 1,000 watts per light; and that written permission from the property owners would be needed.
The council meeting takes place beginning at 7 p.m. Wednesday at City Hall, 525 Henrietta St., between Alhambra Avenue and Castro Street.
