What takes precedence

Here in CA we have Prop 215/H&S 11362. To establish limits on this law the Senate enacted SB 420/H&S 11362.77. In May of 2009 the Second District Court of Appeals determined SB 420 to be unconstitutional. The Attorney General of CA has stated that he will appeal this ruling.

Now for my question. Does the original SB420 law stay in effect, or does the Appellate court ruling take precedence until the new appeal is heard and ruled upon?

Also, since SB420 has been determined to be unconstitutional, can local municipalities prevent dispensaries from opening?
 
My understanding of why they said SB420 was unconstitutional was because the Senate tried to change an initiative that the people voted on. And I guess in cali you can't do that. ANd generally the bills will stay law till the appeal process is complete. Kick the attorneys in the ass and get them to over turn it as quickly as possible.
