Once again the public has a chance to weigh in on if Solano County should allow medical marijuana dispensaries in the unincorporated areas the county.
The Solano County Board of Supervisors will hold a public hearing at 2 p.m. on July 30 to discuss a zoning amendment and consider adopting an ordinance to define and prohibit the establishment of medical marijuana dispensaries within the unincorporated parts of the county.
The public hearing comes a year after the board adopted a 12-month extension to an interim ordinance prohibiting the establishment of any business or facility that cultivates, sells or distributes medical marijuana within unincorporated Solano.
The full text of the proposed amendments to Chapter 28 (Zoning Regulations) are available at Solano County - Resource Management under "Current items of Interest."
Additionally, the board will consider adopting a Negative Declaration of Environmental Impact as recommended by the Solano County Planning Commission.
Staff has had to weigh the federal and state laws since state law indicates the county can't completely prohibit all aspects of medical marijuana use/distribution while federal law says the county can't affirmatively allow it.
County staff advised that public that if someone challenges the proposed consideration in court, they may be limited to raising only those issues raised at the public hearing described in this notice, or in written correspondence delivered to the Board of Supervisors at, or prior to, the public hearing.
Any person wishing to comment on the project and/or review the information contained within the project file may do so at the Solano County Department of Resource Management, Planning Division, County Administration Center, 675 Texas St., Suite 5500, Fairfield.
The hearing will be held in the Board of Supervisors' Chamber, County Government Center, 675 Texas St. in Fairfield.
