San Jose officials are calling for capping the number of medical marijuana dispensaries to 10, about a tenth of the number now believed to be operating citywide.
The proposal by Vice Mayor Madison Nguyen and council members Rose Herrera, Pete Constant and Sam Liccardo will be considered Wednesday by the Rules and Open Government Committee. The committee, which meets at 2 p.m. at City Hall and is chaired by Mayor Chuck Reed, will decide whether to put the proposal on an upcoming council agenda.
San Jose still is weighing regulations that would allow a limited number of medical marijuana dispensaries, all of which now violate city law, in certain areas. Voters in November approved taxing such operations, and the city began imposing the 7 percent tax this month.
But the council members said it has become a burden for the city's depleted staff to respond to complaints about the rapid proliferation of dispensaries.
Erika Taylor Montgomery, representing the All American Cannabis Collective, formerly known as the San Jose Cannabis Buyers Collective, said the proposed cap would only invite lawsuits and "further complicate" a regulatory situation that already is "a huge mess."
