Here is the text of SR12 that calls on the Obama Administration to free Roger Chistie and conduct an investigation into misconduct by Federal law enforcement.

SENATE RESOLUTION
REQUESTING PRESIDENT BARACK OBAMA, OF THE UNITED STATES OF AMERICA, TO INITIATE A FORMAL INVESTIGATION INTO THE CONDUCT OF FEDERAL LAW ENFORCEMENT PERSONNEL IN REGARD TO THE VIOLATION OF THE CONSTITUTIONAL RIGHTS OF, HAWAII COUNTY RESIDENT, THE REVEREND ROGER CHRISTIE.
1 WHEREAS, Roger Christie is a longtime resident of the State
2 of Hawaii and County of Hawaii; and
3
4 WHEREAS, Roger Christie is the Reverend Minister of a
5 church in that county that claims the right to use marijuana as
6 a sacrament; and
7
8 WHEREAS, Reverend Christie, along with several members of
9 his church, were arrested in July of 2010 on charge .relating to
10 the growing and distrib'Htion of marijuana;; and
11
12 WHEREAS, Reverend Christie has no prior criminal record and
13 has not been accused of any acts of violence; and
14
15 WHEREAS, Reverend Christie.has been denied bail on the
16 grounds that he is a "danger to the community"; and
17
18 WHEREAS, Reverend Christie has been held in Federal
19 detention since July of 2010 without the benefit of trial; and
20
21 WHEREAS, Reverend Christie has actively taken the
22 leadership role concerning the efforts to stop Hawaii County
23 from participating in the Federal marijuana eradication effort
24 known as "Operation Green Harvest"; and
25
26 WHEREAS, Reverend Christie has also actively taken the lead
27 role in convincing Hawaii County voters to pass a 2008
28 resolution directing their county police to give marijuana law
29 enforcement the lowest possible priority; and
30
31 WHEREAS, Reverend Christie's political activities have
32 caused annoyance and embarrassment to the Federal Government
33 leading some Hawaii residents to suggest that his denial of bail

1 is based on his prior political acts rather than any "danger" he
2 poses; and
3
4 WHEREAS, the sixth amendment to the Constitution of the
5 United States, says that "in all criminal prosecutions, the
6 accused shall enjoy the right to a speedy and public trial"; and
7
8 WHEREAS, the eighth amendment to the Constitution of the
9 United States, says that "excessive bail shall not be required";
10 and
11
12 WHEREAS, all Federal Government employees, specifically
13 those who have acted to imprison Reverend Christie, to deny him
14 bail, and to deny him a speedy and public trial, have taken an
15 oath to "preserve, protect, and defend" the Constitution of the
16 United States; now, therefore,
17
18 BE IT RESOLVED by the Senate of the Twenty-seventh
19 Legislature of the State of Hawaii, Regular Session of 2013, we
20 believe the treatment of Reverend Roger Christie by the Federal
21 authorities to be illegal and unconstitutional; and
22
23 BE IT FURTHER RESOLVED that we call upon the President of
24 the United States to uphold the law of the land, in accordance
25 with his oath of office to preserve, protect, and defend the
26 Constitution, by instructing the US Bureau of prisons, and any
27 other Federal entity charged with the incarceration of the
28 Reverend Roger Christie, that Mr. Christie is to be immediately
29 released; and
30
31 BE IT FURTHER RESOLVED that we call upon the President of
32 the United States to initiate a formal investigation into the
33 conduct of Federal law enforcement personnel in regard to the
34 violation of the Reverend Christie's constitutional rights, with
35 a goal to determine if any individuals may be held civilly
36 and/or criminally liable for his illegal detention; and
37
38 BE IT FURTHER RESOLVED that certified copies of this
39 Concurrent Resolution be transmitted to the Hawaii County Mayor,
40 all Hawaii County Council members, Hawaii' Congressional
41 delegation, and the President of the States.
