Following a public hearing last week that showcased mixed feelings about medical marijuana in Beaverton, a proposed city ordinance has been polished up for it's first reading at the Beaverton City Council meeting on Tuesday, Feb. 18. If passed later this month, after a second reading and additional public comment opportunities, the ordinance would bolster city code regarding business licensing by tacking on a section specifically focused on medical marijuana outlets. Councilors reviewed a preliminary draft of the ordinance on Feb. 11 and opened a public hearing during which five people testified against banning outlets and one testified in favor of a ban.
The updated ordinance, edited based on councilor requests, specifically outlines the terms of a six-month moratorium. Though the state will begin processing applications and registering dispensaries in March, Beaverton would not issue business licenses for medical marijuana outlets until Sept. 1, effectively banning dispensaries from the city for half a year. Other edits to the ordinance add a 180-day timeline for the city to issue a license — if an application is approved — starting on the day the application is received. New language also notes that the expiration date of the license (they would have to be renewed annually) must be clearly visible for display at the facility. Another tweak to the ordinance would allow the city to conduct a criminal background check before issuing a medical marijuana facility license. One concern raised by city leaders at the Feb. 11 meeting is that terms as important as "marijuana" lacked definition — would the ordinance focus on the plant or all derivatives? The newest version of the ordinance refers to definitions laid out by state statutes, along with adding extra clarification.
Here are a few of those definitions:
Marijuana: All parts of the plant Cannabis family Moraceae, whether growing or not; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant or its resin. (Does not include industrial hemp or mature stalks of the plant.) Medical marijuana: Marijuana used for the exclusive benefit of a person to mitigate the symptoms or effects of the person's debilitating medical conditions. Debilitating medical condition: A medical condition or treatment for a medical condition that produces: cachexia (wasting syndrome), severe pain, severe nausea, seizures, persistent muscle spasms. Also includes cancer, glaucoma, Alzheimers complications, human immunodeficiency virus or acquired immune deficiency syndrome. Tuesday's city council meeting is open to the public and will include a public comment period. The meeting will begin at 6:30 p.m. at City Hall on Griffith Drive.
