Port Orchard Approves Moratorium on Medical Pot Gardens

PORT ORCHARD, WA – The Port Orchard City Council on Tuesday approved a six-month moratorium on medical marijuana gardens, but not unanimously.

Recent changes in state law allow up to 10 qualified patients to cultivate collective gardens with up to 15 marijuana plants per person. No more than 45 total plants are allowed per garden.

The Bremerton City Council approved a moratorium on medical maijuana gardens on Aug. 17. Other local cities and Kitsap County have yet to take action on the gardens.

The Mason County commissioners will hold a public hearing on its moratorium at 9:30 a.m. Sept. 6 at the Mason County Courthouse in Shelton.

Several people urged the Port Orchard council not to prohibit the gardens. Several said they use medical marijuana, but getting it is a struggle.

"It's just such a relief. It helps me throughout daily living," said Jessica Bigelow of Port Orchard, who is on a fixed income and gets medical cannabis from a dispensary in Belfair. "I can't go back to doing it underground on the black market."

Councilman Fred Chang wanted to shorten the moratorium to three months. Chang agrees regulation is needed, but he has pressed for the city to quickly enact zoning and land use regulations on both gardens and dispensaries. Councilman Jerry Childs supported Chang's amendment, but the rest of the council voted it down.

Chang and Childs voted against the six-month moratorium. Voting for the ordinance were Rob Putaansuu, Carolyn Powers, Fred Olin and John Clauson.

The Port Orchard Planning Commission has been discussing what, if any, regulations should apply to medical marijuana dispensaries. The council recently extended its moratorium on dispensaries to February 2012.

With passage of the new moratorium, they will add discussion of marijuana gardens and forward recommendations to the council in 2012.
