Representatives of Mountain View Medical Center in Paradise Valley have withdrawn their application to dispense marijuana in the town.
Jordan Rose of the Rose Law Group, which represents applicant Reggie Winssinger, said until the state decides to implement the dispensary licensing component of the Arizona Medical Marijuana Act, it doesn't make sense to pursue the dispensary. Winssinger owns the medical center.
"Under the current state of the law it is legally impossible to operate a dispensary, so the applicant felt it most prudent to withdraw the application at this time," Rose said.
In May, state health officials put medical-marijuana dispensaries on hold after the state filed a lawsuit to determine whether the medical marijuana law conflicts with federal drug laws.
The law allowing dispensaries narrowly was passed in a statewide vote last November. Since then, cities and towns have been reviewing zoning applications for potential outlets to locate, but the state must grant the actual approval for any business to operate.
For nearly half a year, Winssinger has been working through the town's application process to place a dispensary at the medical complex on the southeastern corner of Tatum and Shea boulevards.
The 2,736-square-foot dispensary would have been in a complex that is home to medical offices.
The Planning Commission unanimously approved the application with stipulations.
However, when the application went to council it began to draw more opposition from nearby neighbors and occupants of the medical complex who feared the dispensary would bring in excess traffic and a criminal element to an area where children live.
In April, the council granted a continuance so the applicant could meet with tenants and residents to clear up concerns. But because of the state's suit, representatives put the application on hold in June. The application was to come before council for a vote Sept. 8, but it was withdrawn.
