A Kern County judge dismissed a motion filed by a group of medical marijuana collectives that said the county board of supervisors violated the California Environmental Quality Act by placing Measure G on the ballot.
Judge Kenneth C. Twisselman II dismissed the motion after citing case law, and the plaintiffs' attorney said he will re-file the motion next week.
Friday's hearing took only a few minutes and the next court date has not been set. The plaintiffs are arguing Measure G violates their due process and California's medical marijuana laws.
The measure, which was approved by voters in June, requires medical marijuana cooperatives and collectives to be located only on industrial land at least one mile away from schools, day care centers, churches, public parks or any other collective or cooperative. Phil Ganong, one of the attorneys for the plaintiffs, has said the measure makes it almost impossible for dispensaries to operate.
