Olathe Puts Kibosh On Dispensary Licenses

" Olathe will not accept new applications for medical marijuana dispensary licenses, its town board decided Monday, invoking authority granted by Colorado's newest pot laws.

The unanimous decision came down after Bill Hewitt " who until June 1 operated the town's only dispensary " walked out of the board meeting, vowing he and his supporters would act as "sovereign citizens."

Mayor Rob Smith said town isn't opposed to people using medical marijuana, as allowed by Amendment 20, and two recent laws: SB 109, which regulates doctors who recommend marijuana to patients, and HB 1284. The latter, now called the Colorado Medical Marijuana Code, imposes new regulations on medical marijuana centers and caregivers, among them, requirements that centers have both state and local licenses and grow 70 percent of what they sell. Caregivers are restricted to five patients.

Certain provisions of the 60-page code could see a legal challenge, said Brian Vicente, an attorney with pro-medical marijuana organization Sensible Colorado.

Under a January ordinance, Olathe charges a $3,000 licensing fee to would-be dispensary owners. Hewitt, who decried the fee as discriminatory did not pay to renew his license, and shuttered his dispensary (THC With TLC) June 1, after police told him he couldn't operate without one.
