Bismarck, N.D. - North Dakota voters will have the final say on a plan to allow medical marijuana.
The Secretary of State has announced a constitutional amendment, the North Dakota Compassionate Care Act, will appear on the ballot November 8.
The initiative petition easily met the state's signature requirements.
If approved by voters the Compassionate Care Act would allow people suffering from certain medical conditions to use marijuana with their doctors' approval.
The proposal would authorize state licensed medical marijuana dispensaries. Registered patients or their designated caregivers would be allowed to grow a up to eight cannabis plants if a dispensary is not available within 40 miles of their home.
Patients would be allowed to possess up to three ounces of medical marijuana.
Right now 25 states, including Minnesota, have laws allowing medical marijuana. But it is still illegal at the federal level and the DEA recently announced marijuana will remain a schedule 1 drug, which declares it has "no medical use or purpose."
