A law that passed through the North Carolina state legislature in 2014 isn't working almost a year later, according to the woman whose daughter it was written about.
The law, which is started as HB 1220, was nicknamed "Hope for Haley." Haley Ward is a little girl who's almost 7 years old. She has a condition called CDKL5 which causes her to have seizures and a host of other problems.
"Hope for Haley" was supposed to allow the little girl to receive an experimental medicine called CBD Oil, or cannabis oils. The oil comes is made from marijuana, though chemically contains almost no THC, what makes people high.
"We were hoping for Charlotte's Web, or another CBD Oil that was similar to it," said Sherena Ward, Haley's mother.
Ward says she's been unable to obtain CBD oil since the law took affect. The law was supposed to make the oil available through pilot studies at North Carolina Universities including UNC, Duke, Wake Forest and ECU. People seeking the oil would participate in these studies under a neurologist. The legislature urged universities to do research, however, Ward says there are no studies happening.
"If we could control the seizures should could have the ability to learn and retain information. All the seizures do is reset her brain each time and set her back," Ward said.
Ward said she wants the CBD oil for her daughter, but at this point it's impossible in North Carolina.
According to Ward, last year she was so full of hope that CBD oil might relieve her daughter's suffering, but now only feels frustration.
CBD oil is not FDA approved. but posted this on their website in regards to it's use on children with epilepsy:
"The FDA understands the interest in making investigational products available to patients while they are being studied for approval, and there are expanded access provisions in both the FDA's statute and its regulations to make this possible."
No legislators were available to talk about the law, though several calls were made.
