MAPLE RIVER TOWNSHIP - A married couple from Alanson was arrested last month by Straits Area Narcotics Enforcement for being in violation of the Michigan Medical Marihuana Act.
On Aug. 20, 2010, Michigan National Guard Raid pilots were flying over the Alanson area -- as part of the Straits Area Narcotics Enforcement's Domestic Cannabis Eradication/Suppression Program -- and alledgedly observed a number of marijuana plants growing behind the residence of 41-year-old John Bryan McLaughlin and 29-year-old Rene Ann McLaughlin, located at 5436 Burt Lake View Drive in Maple River Township.
Shortly thereafter, Straits Area Narcotics Enforcement officers arrived at the home and made contact with the couple.
John McLaughlin informed the officers that he had a medical marijuana card, which according to Section 333.26424 of the Michigan Medical Marihuana Act, states that a qualifying patient can "possess an amount of marijuana that does not exceed 2.5 ounces of usable marijuana."
The law also states that a patient or caregiver can have up to "12 marijuana plants kept in an enclosed, locked facility."
According to an affidavit in 90th District Court, McLaughlin allowed the officers to search his yard and home, where they allegedly found several plants growing freely in his backyard; 11 "very mature" marijuana plants in an unlocked, hidden grow room in the basement; as well as 30-40 quart jars containing processed and dried marijuana in the couple's garage.
Overall, Straits Area Narcotics officers recovered more than three pounds of processed marijuana, 24 marijuana plants and three loaded firearms from the property.
As a result of this investigation, both John and Rene were arrested on Dec. 15.
John was charged with two counts of delivery/manufacture marijuana, each of which are four-year felonies; one count of maintaining a drug house, a two-year, high-court misdemeanor; and three counts of felony firearm, each of which are two-year felonies.
Rene, on the other hand, who claims she had no part in taking care of the marijuana plants, has been charged with one count of maintaining a drug house.
The couple is now awaiting a joint preliminary examination at 3 p.m. on Jan. 26 in district court.
