City Council members narrowly approved a one-year moratorium on medical marijuana distribution facilities Monday night.
A 4-to-3 vote on the measure extends a previous six-month moratorium on the facilities passed in February, based on a Michigan Court of Appeals ruling in 2011.
A three-judge Court of Appeals panel ruled in August 2011 that Mount Pleasant-based dispensary Compassionate Apothecary, LLC could be shuttered because of patient-to-patient sales and declaration of the facility as a public nuisance.
"We had hoped so," said Attorney Amanda Doyle of a ruling on the case, following a question by City Council Vice President Duane Haskins about the case due before the Michigan Supreme Court this fall.
"At this point, we don't know if it's going to be a week, six months, or a year," she said of any potential ruling by the state's highest court.
Councilman Danny Wells voted against the measure, as did Councilman Steve Heffner and Council President Tom Martinbianco.
Wells stated he voted against the previous moratorium before casting his no vote Monday evening, noting "Somebody's got to push the Attorney General's hand on this."
"I think if people come forward, let's let them do it at their own risk," he said. "As we do with everybody else."
Mayor Paula Zelenko said the city there may be one or two sites left available in the city for medical marijuana distribution facilities based on the city's zoning restrictions, but "We've only turned down one (application)."
Burton currently has four medical marijuana dispensaries that are still allowed to operate as they were approved prior to the previous moratorium.
