Portage's proposed medical marijuana ordinance dealing with zoning standards will get its first public hearing Thursday at the Portage Planning Commission.
The 7 p.m. hearing at Portage City Hall will detail and take public comments on the 11-page zoning ordinance proposal dealing with five medical marijuana facilities: provision centers or dispensaries, growers, processors, safety compliance and transporters.
Provision centers are proposed to be in a B3 zoning district, with about 13 locations identified in the city as potential sites, and could not be adjacent to residential zoning districts and be 1,000 feet away from a school, library, child care center, playground or park.
Growers, processors, safety compliance and transporters would be in industrial zoning districts, again not adjacent to residential zoning districts and 1,500 feet away from a school, child care center or playground. About 14 locations are identified on a map for growers and processors. Safety compliance and secure transporter facilities are expected to have 100 locations, but city officials expect far fewer of these types of facilities to apply.
While the Planning Commission will deal primarily with the zoning ordinance, the business ordinance amendment specifying the permit process for the five facilities will likely be brought up but is not a part of the commission's eventual vote.
The city has a proposed timeline that includes Thursday's Planning Commission hearing: Jan. 18, possible approval of the zoning amendments by the commission; Jan. 23, council first reading of draft ordinances; Feb. 20, council special meeting and public hearing on draft ordinance; March, open window for applications for prequalified candidates determined by the Department of Licensing and Regulatory Affairs.
In December, the Portage City Council unveiled the proposed medical marijuana ordinances that would license facilities and set zoning standards. It sparked a few questions and public comments but no significant objections or changes.
The council committee of the whole meeting attended by more than 40 people introduced the 22-page draft ordinance regulating five types of medical marijuana facilities and the 11-page zoning ordinance proposal.
The council last month also passed an emergency ordinance allowing the city's only medical marijuana dispensary to stay in business while Lake Effect pursues a state license.
