The Barnstable Town Council will get its first glimpse at a Medical Marijuana Treatment Center Overlay District located at the "very east end of Main Street."
The zoning district comes in response to the passage of Question 3 on the November ballot legalizing medical marijuana in the commonwealth.
The state law goes into effect Jan. 1 and allows for up to 35 medical marijuana facilities, with up to five in each county.
The creation of a district will allow the town to keep such centers from popping up anywhere in town that allows medical facilities. There are no known facilities proposed for the town of Barnstable.
The district borders the town of Yarmouth and encompasses several of the roads around Cape Cod Hospital, Including a portion of East Main Street.
A similar approach was taken with adult entertainment zones in the late 1990s. Towns are not allowed to ban such businesses, but they can be regulated and zoned to specific areas.
An overlay district was created in a portion of the town's industrial zone in Hyannis. While there have been no applications for such a facility since its creation, it remains the only area where one could be sited in Barnstable.
Town Council President Fred Chirigotis is listed as the sponsor of the proposed district. At the last council meeting Chirigotis spoke of getting out head of the new law and getting something on the books to regulate them.
"The properties included in this overlay district location near Cape Cod Hospital will provide an area adequate for reasonable use," The agenda item summary reads. "This use is limited to locating outside 500' from schools, churches and youth centers. Nothing in this ordinance or the state law allows criminal activity to take place."
The town council is expected to refer to the proposal to the planning board for its review and recommendation. A public hearing before the council would follow.
