A Superior court judge has upheld Gilroy's decision to prohibit medical marijuana dispensaries in the city.
The ruling paves the way for the city to issue an injunction to shut down the Medi-Leaf clinic in West Gilroy.
The dispensary has maintained that since it's a not-for-profit operation they can operate without a business license.
However, Judge Kevin McKenney had ruled that under the city code, non-profits must obtain permission from the city in order to operate.
