A medical marijuana dispensary has been operating in Poway for a good part of August, despite a city ordinance prohibiting such a business.
The Wellness Tree Poway Association, located at 13526 Poway Road, began selling medicinal marijuana about Aug. 6, according to the company's website.
A worker at the Poway site, a former chiropractic office in the Town & Country shopping center, identified himself on Monday only as "Dan." He said he was under the impression that medical marijuana dispensaries are allowed by law in California, although he did hear that Poway has an ordinance that restricts such business.
"Our landlady is perfectly fine with it," he added, although he was not comfortable in giving her name.
According to "Dan," customers are encouraged to knock on the back door of the shop, which has a surveillance camera to help identify the customer.
"They like that we are discreet – and safe," he added. "Many are from Poway and like that they don't have to drive to San Diego."
Meanwhile, the front door remains locked at all times, he said.
Two Poway deputies tried to access the shop Monday morning, but were denied access, said Deputy Chad Dollick, who regularly patrols the area.
He said that his station got a call Monday notifying the Sheriff's Department about the existence of the newly opened dispensary.
The Poway City Council approved an interim ordinance July 6 preventing medical marijuana dispensaries, collaboratives and collectives from being established in the city.
On Aug. 12, council members extended the 45-day ban for another 10 months and 15 days, while the city researches land-use zones and allowing such a business to operate within city limits.
The moratorium came after a Los Angeles man, Daniel Lutz, was denied a business certificate to operate a marijuana collective after submitting his application to the city of Poway.
Lutz was planning on operating St. Bernard's Provisions, Inc. at 13524 Poway Road, next door to newly opened Wellness Tree location.
