Marijuana Dispensaries On Agenda

When and where to allow medical marijuana dispensaries in unincorporated areas of Solano County will once again be the topic of discussion for Solano County Supervisors on Tuesday.

The Board of Supervisors will hear a report from staff on the latest legal framework with regulating marijuana dispensaries in the state, get a background report on siting options for such dispensaries on county lands and consider a plan for hosting a series of public meetings on the matter.

In 1996, California voters approved the "Compassionate Use Act," allowing the use of marijuana for medical purposes. That was followed in 2004 by the Medical Marijuana Program Act that allowed for the creating of medical marijuana identification cards. County staff reports that to date, the Public Health Department has issued 131 cards in Solano.

In 2009, the board adopted an urgency moratorium on dispensaries, it has been extended several time as the county studied the issue. In July, the board held a public hearing and considered adopting an ordinance to ban dispensaries from county lands but opted not to adopt the ban and directed staff to come back with a regulatory framework that would include potential locations or districts, the quantity of dispensaries at those locations, potential location constraints, proposed fees, hours of operation rules, and membership requirements and to conduct public outreach on the matter.

Since then, county staff has been evaluating zoning districts for residential, commercial and industrial uses "in order to determine which would be most appropriate for the establishment of medical marijuana dispensaries," explains a staff report to the board. "Because dispensaries often have a storefront or medical office characteristic, staff's initial baseline for analysis were zoning districts that allow commercial type uses."

Staff found nine commercial areas in the unincorporated county that could be considered as potential locations for dispensaries. In Northern Solano County, it includes the Gibson Canyon area in Vacaville, Quinn Road in Vacaville, Midway Road at Interstate 505 and Midway Road at I-80, among others.

Staff will ask the board to consider a public outreach program that will include four public meetings to seek comment in regard to potentially establishing medical marijuana dispensaries on unincorporated lands. The meeting would be held in Dixon, Vacaville, Winters, Vallejo and Fairfield, under the proposal.

If the plan is approved, staff would report back to the board in December on its findings and to get further direction.

Tuesday's meeting of the board is set for 9 a.m. in the County Government Center, 675 Texas St. in Fairfield.
