Mass Medi-Spa says it still plans to open a medical marijuana dispensary in the Accord Business Park in Norwell despite local officials' concern that a bounced check and late payment mean the company won't be able to finish the project.
"It's unfortunate that there was a communication breakdown between the town [and Mass Medi-Spa], and we're going to obviously do a better job so there are no future miscommunications," Mass Medi-Spa's president, Jeffrey Roos, said in a phone interview. "We're working as hard as possible to get open," he said.
He said the company is halfway toward getting financing and hopes to have final state approval to open both the Norwell dispensary and one in Nantucket by next summer.
Mass Medi-Spa received provisional approval from the state Department of Public Health in June 2016, and said then it would open this summer.
Norwell Town Administrator Peter Morin said town officials became concerned when Mass Medi-Spa failed to pay the town $100,000 on June 30 -- an amount Morin said was part of the town's host agreement with the company.
That worry escalated when a $5,000 check from Mass Medi-Spa, for a building permit, bounced, he said.
Roos said his interpretation of the host agreement is that payment isn't due until his company has a final license to operate from the state. As for the bounced building permit check, Roos said the bank closed the company's account because "it doesn't do medical marijuana business."
"Unfortunately that's the state of the industry; banking has been a problem," he said, adding that he had re-sent the payment to the town from a new account.
Morin said if he hadn't received the money within a week, the town would have to examine the status of the project.
"I'm trying to re-establish communication and credibility," he said. "We're not at the point of talking to someone else, but we're very confident that the site is attractive and we have" other options.
