KALAMAZOO, MI -- This could get confusing, but then it's about a proposed Marijuana law, so confusion seems to go with the territory.
Kalamazoo City Commissioners are expected Monday to formally receive the governor's rejection of a proposed city ballot initiative to make possession of less than an ounce of marijuana by anyone over 21 the "lowest priority" for Kalamazoo Public Safety officers.
Despite the governor's disapproval, it will still go on the ballot under the Home Rule City Act. It is the opinion of both state and city attorneys that even if it passes, it's unenforceable because state and federal law would supersede a local Charter amendment.
There may be another problem with the measure. The age of majority is 18, not 21. Supporters say it will free up Public Safety to work on more serious crimes. Opponents say it's meaningless and just further muddies up what has already become a muddy issue in Michigan.
