CA - With little discussion Wednesday, the Lodi City Council extended a temporary ban preventing medical marijuana outlets from opening in Lodi for another year.
In May 2008, the city temporarily banned anyone from opening or operating a dispensary to give staff more time to research the possible effects of the shops in Lodi. That ban was set to expire on April 14.
The council unanimously approved extending the ban until April 2011.
Robin Rushing, who uses medical marijuana, was the only person from the public who spoke on it, and he said that it would be more convenient to get his medicine in Lodi.
City Attorney Steve Schwabauer recommended the extension because of several pending court cases focused on the regulation of medicinal marijuana dispensaries.
She mentioned one particular case, Qualified Patients Association v. the City of Anaheim. The case is before the Court of Appeals in the 4th District, and the court is expected to rule on it in the next few months. Magdich wrote that the ruling could change how cities can regulate medical marijuana dispensaries.
The original ban in May 2008 was considered after the city received three inquiries in March 2008 about opening a medical marijuana outlet in Lodi.
