Here on the central coast, the new policy is welcomed by medical marijuana users. But you may be surprised to hear what law enforcement has to say about it.

Here's a look in a balanced report.

The fight over medical marijuana enters another round and this new policy is welcomed by medical marijuana users, especially, Charles Lynch. Lynch says, "I think the judge is probably going to take note of this in his final decision may have an affect on my appeals process and you know it's definitely good news."

In June, Lynch was convicted on five federal charges for running a medical marijuana dispensary in Morro Bay. He was sentenced to spend a year and a day behind bars.Right now, he's out on bail, pending an appeal.

He says the change in policy may help his case.

San Luis Obispo County Sheriff's Department Spokesperson, Rob Bryn, says It essentially changes nothing and it's not likely it will help his case. Bryn says,"It doesn't change anything. Marijuana is still illegal in California, especially the way they were doing the dispensaries. Not only here but the city and county of Los Angles are raiding dispensaries on a daily basis because it's no more than legalized or attempted legalized drug dealing.">

Lynch says, "it's silly these law enforcement people are still trying to circumvent the will of the people."

Law enforcement officers say the will of the people doesn't change the fact that it's illegal to sell and grow marijuana in California.

Still, advocates say the new policy is a sign of good things to come.

Lynch remains free on bail. No date has been set for his appeal. In the meantime he's subject to random drug testing. As part of his arrangement he's not allowed to smoke marijuana.
