The sentencing hearing for Steve Kubby is still on for February 2nd, but a
second hearing now looms for February 9th as well.
Kubby Defense attorneys David Nick and Tony Serra have just informed Judge
John L. Cosgrove that they will not be able to attend the court hearing on
February 2nd. Both attorneys have requested a postponement of the
sentencing part of the hearing.
One important question that is expected to be answered on Feb. 2nd is the
issue of retrying the Kubbys after a jury split 11-1 to acquit. Attorney
Carrie Hagin will represent the Kubbys, while the Placer County District
Attorney reports to the judge whether they have decided to retry or dismiss
the case.
David Nick has asked for a one week continuance in order to prepare motions
arguing that both convictions against Steve Kubby were improper and should
be reduced from felonies to misdemeanors.
