AUBURN -- Judge John L. Cosgrove today denied Prop. 36 protection to Steve
Kubby for his misdemeanor convictions for a mushroom stem and tiny peyote
buttons, saying that any use of marijuana, even medical use, would
disqualify Kubby, according to rules adopted by Placer County. Public
Defender Julie Mumma argued that the county cannot overrule an initiative
and that she would appeal.
Prosecutor Christopher Cattran strenuously demanded Kubby be sent to jail
for refusing probation, registered as a drug offender, and forbidden from
using medical marijuana, without any further delay.
In a surprise move by the Placer County Jail, an official asked to speak to
the court. The jail official said that they were not prepared to "care for"
Kubby, since under current rules they cannot allow him to have marijuana or
Marinol. The official requested an extension of the date that Kubby must
turn himself in to jail from May 22nd to July 22nd, indicating their hope
that the Supreme Court decision will provide an answer.
Judge Cosgrove then agreed and Kubby was cleared to return to his home in
British Columbia, pending appeal.
"Propositions 215 and 36 weren't difficult for voters to understand, but
Placer County officials seemed determined not to understand, obey or even
tolerate these laws as written and passed by the People," said Kubby.
"Obviously, the criminal justice system is broken in Placer County and it is
time we do something to fix it, starting with the recall of the Placer D.A."
Kubby has informed the Probation Department that he will continue to refuse
probation, fines or registering as a drug offender. An online contribution
