Federal authorities have indicted and arrested six men connected with the operation of G3 Holistic, a chain of Inland medical marijuana dispensaries that had stores which the indictment says were actually for-profit marijuana sales storefronts which tried to hide more than $3.3 million in profits "to maintain the façade of G-3 Holistic as a non-profit organization."
The action was announced Thursday, June 14.
Investigators have claimed G3 was using California's medical marijuana laws as a cover for illegal sales, with those who become G3 customers actually not involved in the kind of cultivation collective that the state law says must exist for a legal medical marijuana dispensary.
G3 operated stories in Upland, Colton and Moreno Valley. The Colton and Moreno Valley stores have been shuttered, but the Upland store remained open after federal agents executed two separate search warrants on it, filed an asset forfeiture lawsuit against the property housing the G3 store, and filed a second asset forfeiture lawsuit against regarding $11,500 seized during a November raid against the store, according a news release.
Those indicted include co-founders of the G3 chain and a growing operation associated with it inside on Ontario warehouse, according to the six-count indictment.
The indictment charges all six defendants with conspiracy to manufacture and to posses with intent to distribute marijuana and possession with intent to distribute marijuana. The two charges carry a mandatory minimum sentence of 10 years in federal prison and a maximum possible sentence of life in prison. Each defendant is also named in at least one count of maintaining a drug-involved premises, which carries a mandatory sentence of 20 years, if convicted.
In an October 2011 search warrant, a Drug Enforcement Agency agent said the two men who started and operated G3 "run a marijuana drug trafficking organization." The affidavit for the search warrant said those being investigated were "claiming to cater exclusively to persons suffering from medical illnesses, when in fact persons with any medical condition can purchase marijuana at these retail establishments."
"The customer does nothing to participate in the 'collective' other than to purchase marijuana, and is not involved in any aspect of the cultivation of marijuana," the search warrant stated.
The release said those indicted include:
- Aaron Sandusky, 41, of Rancho Cucamonga, who is a founder and owner of G3;
- John Leslie Nuckolls II, 31, of Rialto, who is a founder and owner of G3 and who has called himself the (chief financial officer) of G3;
- Keith Alan Sandusky, 44, of Rancho Cucamonga, who was in charge of day-to-day operations of G3;
- Paul Neumann Brownbridge, 29, of Upland, who worked at the Ontario grow operation;
- Richard Irwin Kirchnavy, 45, of Rancho Cucamonga, who worked at the Ontario grow; and
- Brandon Anton Gustafson, 30, of Yucaipa, who worked at the Ontario grow site.
