A Tulare County Superior Court judge said today he wouldn't grant a request by Tulare County to shut down a medical marijuana collective operating near Ivanhoe.
The county sought the injunction to prevent Foothill Growers, Inc., from continuing its activities of growing marijuana and distributing it to about 100 members with medical recommendations to smoke of ingest the drugs to treat various medical conditions.
The land leased by the growers is zoned AE-20 – for agricultural use with a minimum 20 acres – and officials say county zoning rules don't allow for growing medical marijuana on agriculturally-zoned land.
In his ruling, Judge Paul Vortmann wouldn't grant the injunction against Foothill Growers, saying in a written statement that the county "has not sufficiently shown that the cooperative operated on the subject property violates the county's existing zoning structure" considering that the area has a long history of uses not conforming with local zoning.
County officials would not comment on the ruling after the hearing at the Visalia Courthouse.
