AUBURN -- Flanked by armed escort deputies, prosecutors were in court on
Friday, a day after closing arguments, to defend one of the charges against
the Kubbys, possession of concentrated THC.
Defense attorneys J. Tony Serra and J. David Nick argued that the charge
against the Kubbys was for the more serious crime of manufacturing hash oil,
when the Kubbys had simply collected resin from their plants, in the normal
process of manicuring their medicine. When asked by Judge John L. Cosgrove
what THC was and why the Kubbys were so charged, Deputy District Attorney,
Christopher Cattran attempted to explain.
Jane Weirick, a nun who directs a medical marijuana dispensary supported by
the Catholic Church in San Francisco, found Cattran's explanation so
"silly," she laughed in the courtroom, prompting Deputy District Attorney
Gene Gini to ask Judge Cosgrove to remove Sister Weirick. Judge Cosgrove
told Gini and Cattran, "If the District Attorney is going to make such
remarks, he should expect to be laughed at." Cosgrove then dismissed the
hash oil charge against both Steve and Michele.
Clearly upset by the THC charge being dismissed, Cattran then made a motion
to "amend the complaint." An incredulous Judge Cosgrove told both Cattran
and Gini he found such a motion offensive. "I've been a prosecutor for 8
years and served on this bench for 18 years and I've never seen a prosecutor
try to amend a complaint after the defense has rested. Motion denied!"
"With all due respect!" argued Cattran. . .
"NO due respect Mr. Cattran, motion denied," blasted Judge Cosgrove, who
added, "Motion denied, do you understand? MOTION DENIED!"
Cattran and Gini were so upset by the rebuking they received from the judge,
that they stormed out of the courtroom, armed escorts in tow, while court
was still in session.
"Let them go," said a weary Judge Cosgrove, as the prosecutors angrily
slammed the doors of the courtroom.
