IL: Devine Discusses Decriminalization Of Cannabis

Gov. Bruce Rauner's decriminalization of small amounts of marijuana will have an impact on Iroquois County.

Last week SB2228 was signed and is now in affect. It states individuals are allowed to have up to 10 grams of marijuana, punishable by a fine instead of a misdemeanor with possible jail time.

States attorney Jim Devine said his office has typically prosecuted 75-100 of such possessions a year. "Before, I'd prosecute any amount found, placing charges."

Now, he said, "It's still illegal but there's no criminal prosecution (when there's less than 10 grams)."

Prior to SB2228, Cannabis Control Act placed charges on possession of less than 2.5 grams a Class C misdemeanor, punishable with $1,500 in fines and up to 30 days in jail, and 2.5-10 grams was a Class B misdemeanor, punishable with $1,500 in fines and up to six months in jail.
