Becoming a patient in Oklahoma
Summary
In April of 2015 Gov. Fallin signed HB 2154, Katie and Cayman's Law. The law creates an exemption for the possession and use of CBD-rich cannabis oil from the criminal definition of marijuana in limited circumstances. Patients are eligible for legal protections after the patient obtains a recommendation for CBD oil from a physician for a qualifying condition. The law requires that the CBD oil be no more than 0.3 % THC. The law also states that the CBD oil for these studies must come from a FDA-approved source. In 2016, the law was expanded to several conditions and removed the age requirements.
What's Legal
Qualifying patients are protected from arrest, prosecution, civil penalties and discrimination for use and possession of cannabis that contains no more than 0.3% tetrahydrocannibinol (THC). There is no requirement for state registration and the law is silent on cultivation and distribution of cannabis.
Eligible conditions
Application process
There is no formal patient registration set forth by the law; however, patients must be enrolled in an authorized clinical research program in order to obtain legal protections and access to CBD medicine.
Doctor
Any physician licensed by the State Board of Medical Licensure and Supervision or the State Board of Osteopathic Examiners, practicing in this state, and treating patients with severe forms of epilepsy may serve as the principal investigator for clinical trials of CBD oil.
Access/Caregivers
Since all patients must be age 18 or younger the law does extend protection to parents, legal guardians or caretakers. The law does not create a production or distribution system. The law does remove criminal penalties for patients and their parents, legal guardians or caretakers for the possession CBD oil that has no more than 0.3% THC.
Consumption
The law does not impose restrictions on where patients may use their medicine.

While there are no explicit privacy protections, there is no patient registry under the law.

- Lennox-Gastaut Syndrome
- Dravet Syndrome, also known as Severe Myoclonic Epilepsy of Infancy
- Any other severe form of epilepsy that is not adequately treated by traditional medical therapies
- Spasticity due to multiple sclerosis or due to paraplegia
- Intractable nausea and vomiting
- Appetite stimulation with chronic wasting diseases
