Frisco Town Council members passed a slightly more lenient version of their retail marijuana ordinance during their meeting this week.
The final document removes the clause allowing only two retail establishments within city limits, but strict requirements remain in place regarding where the facilities can be located.
Recreational marijuana operations will not be permitted within any residential zoning, the central core zoning district or the mixed-use zoning district along East or West Main Street. No applicant will be licensed within 500 feet of a licensed child care facility, educational institution, halfway house, correctional facility or within 500 feet of another marijuana business. Also, the location can't be within any building containing a pediatrician's office, hotel, motel, condominium or boarding or lodging facility.
"We think that will control the number pretty well," Frisco town manager Bill Efting said.
The retail marijuana ordinance, passed unanimously by the council, also extends the hours retail marijuana operators would be allowed to be open for business. It permits retail establishments to do business until to 10 p.m. rather than the originally proposed closing time of 7 p.m.
The final notable change to the ordinance, differing from the first draft of the document read by the council in late August, is that it would open up retail marijuana facility licenses to potentially include marijuana cultivation or products manufacturing on the same premises and under the same ownership as the retail store.
"I don't think anybody has all the answers yet, but we feel comfortable (with) the ordinance," Efting said on behalf of the council. "We just have to keep paying attention and follow what the state is doing."
The town of Frisco plans to charge $3,000 for its retail marijuana license fee to cover costs of enforcing regulations set through the ordinance.
The council has also approved a ballot measure that would enact a 5 percent tax on the retail sale of marijuana. If approved by voters in the Nov. 5 election, this tax would go into effect on Jan. 1, 2014.
