The February 2nd sentencing hearing for Steve Kubby has been taken off
calendar and the Kubbys will not be appearing in court that day.
The continuance was forced by the Placer County Probation Office not
completing its report in time for the hearing. In addition, defense
attorney David Nick has asked for the continuance in order to prepare
motions arguing that both convictions against Steve Kubby were improper and
should be reduced from felonies to misdemeanors.
No decision has been made yet regarding retrial of the Kubbys. According to
attorney Carolyn Hagen, Placer County prosecutor Christopher Cattran advised
her that a decision will be made on retrial no later than the next court
date of March 2, 2001.
