El Paso County Commissioners Ban Retail Marijuana Stores In Unincorporated Areas

El Paso County Commissioners Tuesday voted 4-1 in favor of banning retail marijuana stores and cultivation of recreational marijuana in unincorporated areas of the county, effective March 1. The ban also includes marijuana testing facilities and marijuana product manufacturing facilities. Commissioners utlized the local opt-out included in Colorado's Amendment 64, which allows possession and use of small amounts of recreational marijuana. The ordinance means no retail marijuana stores will be allowed to operate in unincorporated areas of the county and cultivation for supply to retail operations will also be prohibited. The ordinance does not change any current regulations regarding medical marijuana in unincorporated areas of the county, but many in the medical marijuana industry say the ban will have far-reaching impacts on them, perhaps driving many MMJ grow operations and dispensaries out of business.
