The Colorado Court of Appeals has upheld the conviction of a man who brought marijuana-laced garlic butter inside a Mesa County Community Corrections facility, overruling claims he should have been allowed to present evidence of a doctor's recommendation for its use.
Vincent Iversen was arrested in 2009. He was convicted on one count of attempted introduction of contraband into a detention facility and sentenced to four years' probation, 90 days in jail and 600 hours of community service.
According to the Grand Junction Daily Sentinel, the Court of Appeals noted that Iversen, while in custody, had fallen off a bunk bed and suffered a broken hip and back injuries. Iversen visited a doctor who issued a certificate recommending use of marijuana concentrate under Colorado's new medical marijuana laws.
