Members look at water debt
Fort Morgan City Council members will see the first draft of an ordinance banning commercial medical marijuana operations in the city, and discuss whether or not to refinance the city's water fund debt when they meet at city hall Tuesday evening.
During the most recent legislative session, state lawmakers created a bill that allows cities and counties to ban or regulate the operations of medical marijuana dispensaries and growing operations,
Before the bill was passed, the city had a temporary moratorium on such operations, and decided to ban them after a public hearing on the topic.
The ordinance says that after consideration of the impacts associated with medical marijuana operations the city has concluded that there would be an "adverse effect on the health, safety and welfare of the city and inhabitants thereof."
While individuals would still be able to grow and use their own medical marijuana if they are authorized by the state, any operations that were established would be fined $1,000 per day as long as they remained open, the ordinance says.
Council members will also discuss, and perhaps ask staff to take action on, investigating and preparing a proposal for refinancing of debt in the water fund.
Before the 7 p.m. regular council meeting, the council will meet in a closed-door executive session starting at 5:30 p.m. to consider undisclosed negotiations on property acquisition.
They will also consider:
Removing ex officio members from the Fort Morgan Planning Commission in order to provide a more fair and impartial decision-making process.
Hear the first presentation of a proposed ordinance to amend the city municipal code to include updates required under federal law, with part of that applying to the sewer system water treatment standards.
Appointing Mayor Terry McAlister to the Fort Morgan Historic Preservation Board.
A request by the Fort Morgan High School Booster Club to waive the fees the city charges for use of picnic tables during scheduled events Aug. 20-23.
Scheduling a public hearing for Sept. 7 for a special events permit for the Elks Club.
Approving a renewal of the liquor license for Acapulco Bay restaurant and the modification of the premises of the restaurant.
Approving a 3.2 beer license for Pizza Hut.
Approving a report of changes at the Elks Lodge.
