Council To vote On Changes To Marijuana, Development Code Language

The Greeley City Council on Tuesday will consider an ordinance that brings the city's current ban on medical marijuana dispensaries in line with language in House Bill 1284, which was passed last session by the Colorado Legislature.

The council meets in regular session at 6:30 p.m. in council chambers, 919 7th St.

The legislation adopted new terminology including "medical marijuana centers," instead of "dispensaries," and "medical marijuana-infused product," "medical marijuana-infused products manufacturer" and "optional premises cultivation operation."

Current Greeley code defines a medical marijuana dispensary as being "the use of a property for profit or otherwise which is operated by any person including, but not limited to, a patient or caregiver and which is used to cultivate, distribute, transmit, give, dispense or otherwise provide marijuana in any manner to any other person."

City Attorney Rick Brady said the city probably went too far in banning the caregiver aspect of the law, which, as intended by voters who approved Amendment 20 a decade ago, allows a "caregiver" to provide medical marijuana to a small number of people. Brady told the council at a recent work session that Greeley can't go so far as to deny a caregiver so long as he or she has five clients or less.

The council will also consider on final reading an ordinance that amends aspects of development code to fall in line with standards in the 2060 Comprehensive Plan and development code.

The modifications relate to parts of overlay districts, zoning district development standards, general performance options and off-street parking and loading standards.
