Colorado: Would A City Recreational Vote Clash With 64?

City Council's plan to let voters decide this November whether to license recreational marijuana stores in Pueblo sounds like a wise decision, but it may not be a legal one according to Amendment 64, which legalized recreational pot in Colorado.

The 2012 state amendment legalized recreational pot and said it can be regulated and taxed like alcoholic beverages.

But down in Section 5, part F, the amendment also warns that voters in any county, city or town can choose to ban recreational pot businesses in their locality, but that vote can only occur during general elections, in even-numbered years.

Meaning not this November, which is when council intends to ask city voters "shall the establishment and operation of retail marijuana stores be permitted in the city of Pueblo . . ."
