Colorado senators on Thursday passed Senate Bill 283 by a 32-2 vote on third reading, which implements regulations surrounding Amendment 64 on marijuana.
The measure now heads to the House of Representatives for a vote.
The bill, one of three winding through the Legislature on Amendment 64 issues, creates penalties for marijuana possession by a minor to mirror minor-in-possession-of-alcohol laws, establishes training for police on roadside impairment tests and adds marijuana to the Colorado Clean Indoor Air Act, among other provisions.
Colorado voters in November passed Amendment 64, which legalizes the recreational use and possession of less than an ounce of marijuana for those 21 years or older.
"We are breaking new ground in public policy as we implement this sweeping regulation while keeping faith with the intent of the voters," said Sen. Cheri Jahn, D-Wheat Ridge, one of the bill's sponsors.
The bill also prohibits marijuana from school grounds, child care centers, homeless youth shelters, community residential homes, etc. It also creates an "open container offense" for marijuana, mirroring alcohol open-container laws.
The other two bills concerning Amendment 64 are HB 1318, which will ask voters in November to establish sales and excise taxes on marijuana to pay for the state to regulate it, and HB 1317, which converts the state's Medical Marijuana Enforcement Division to the Marijuana Enforcement Division to regulate both recreational and medical marijuana, and gives existing medical marijuana dispensaries first crack at establishing retail recreational marijuana stores. The Legislature is considering those.
