A Grand Valley resident has filed a lawsuit against the town of Palisade claiming a town ordinance over medical marijuana sales is unconstitutional.
Ordinance 6-85, voted in local election, states if the town's population is less than 4,000 people, the town will issue only one medical marijuana business license within town boundaries.
"The vote was only suppose to be for a yes to allow it [medicinal marijuana sales], free market principles to apply across the board, or a no, it's not allowed within town limits," said King.
Claiming the ordinance violates part of the Colorado Constitution and the Colorado Anti-Trust Act of 1992, King has requested the Colorado Attorney General's office to investigate the town of Palisade for any violations and wrongdoing.
"They've set up a monopoly situation for one entity and one business in the town and that's concerning," said King.
King's filed complaint is also asking for an order to suspend all medicinal marijuana licenses until residents can vote on what he refers to in his complaint as a "corrected constitutional town ordinance."
"If there's nothing to hide in the town of Palisade, there is nothing to fear in this investigation," King added.
As of Monday, Palisade Town Manager Rich Sales told News Channel 5 the town had not formally been served the lawsuit, but will be in touch when it does.
