At the request of Delta City Council, city attorney Mike Schottelkotte has prepared an ordinance which would prohibit medical marijuana businesses and operations. The ordinance was expected to be presented to the city council at its Jan. 18 meeting.
After a second and final reading, the ordinance will make it unlawful to operate any medical marijuana center, optional premises cultivation operation or medical marijuana infused products manufacturing or sale facility within city limits. Only medical marijuana patients and primary caregivers, as defined by state law, will be permitted to use, cultivate or possess marijuana.
The ordinance will force the closure of the only medical marijuana dispensary in the city. The ordinance notes, "Although operation of such business has essentially been tolerated while Colorado legislation on the issue of their legality was being debated, enacted and implemented, the City of Delta has not licensed or othwerwise authorized the operation or such business or waived its right to seek prosecution of that business as a violation of state and federal laws which long pre-dated the opening of the business, or to otherwise regard the business as nuisance under applicable provisions of the Delta Municipal Code."
If passed, the ordinance would become effective July 1, which would provide Natural Green Solutions, Delta's only medical marijuana dispensary, several months to sell its remaining inventory and close its doors.
