Arizona's new voter-approved medical marijuana law has cities scrambling to approve zoning and permit regulations for dispensaries and cultivation before the state health department begins reviewing applications in April. Proposals for restrictions in Chandler, including those below, go before the city's Planning and Zoning Commission on Wednesday for an advisory vote before it goes to the City Council in February. The 7 p.m. commission meeting is in City Council Chambers, 88 E. Chicago St.
BASIC PROVISIONS: Operators must obtain a use permit and are not allowed by right in any zoning district. The city restrictions are in addition to lengthy state rules.
ACCEPTABLE LOCATIONS: Dispensaries would be allowed in several kinds of commercial areas. Cultivation and infusion facilities will be limited to commercial locations zoned for industrial, not retail, businesses.
PERMIT CRITERIA: All facilities, including cultivation operations, must obtain a permit and a city business license. They have to be located in permanent buildings, not temporary structures, and be no larger than 3,000 square feet.
OPERATIONS RULES: No consumption of marijuana would be allowed on premises, and dispensaries can not deliver their products to customers or have take-out windows.
DISTANCE REQUIREMENTS: At least 5,280 feet from another medical marijuana facility and 1,320 feet from a school, park, day-care center, place of worship, library, hospital or residential zone.
