Chandler Medical-Marijuana Rules Recommended by Commission

Chandler Planning and Zoning Commissioners unanimously recommended regulations for medical marijuana cultivation and dispensaries Wednesday night that require separate permits for selling and cultivating, allow 9 a.m. to 9 p.m. hours of operation and restrict locations.

However, the vote removed distance requirements from neighborhoods and private parks like those in homeowners' associations, leaving mandatory separations from public parks, schools and churches.

An earlier proposal by planners recommended 9 a.m. to 7 p.m. hours. The rules will go to the City Council for approval Feb. 10. Chandler is one of the last major Valley cities to draft medical marijuana rules after Mesa, Tempe, Gilbert and Phoenix.

The unanimous advisory vote came after commission members and city staff voiced concerns about potential for theft if Chandler allowed marijuana deliveries to home-bound patients and about a proliferation of dispensaries if they were allowed to sell other products and services and increase revenues.

Under the commission recommendations, dispensaries would be allowed in several kinds of commercial areas. Cultivation and infusion facilities will be limited to commercial locations zoned for industrial, not retail, businesses.

All facilities must obtain a permit and a city business license and have to be located in permanent buildings, not temporary structures, no larger than 3,000 square feet.

No consumption of marijuana would be allowed on premises, and dispensaries can not deliver their products to customers or have take-out windows.

Dispensaries must be at least 5,280 feet from another medical marijuana facility and 1,320 feet from a school, public park, day care center, place of worship or library.
