A medical marijuana center on the north side of town wants its formal approvals to operate as a dispensary and cultivation facility and is applying for the necessary permits from the Board of Trustees.
The CMED MMJ Center, at 615 Buggy Circle, has been operating since the end of June 2010 and has a 22-year lease on the premises, according to a document submitted to the town by John and Karen Salamida, owners of the building.
The building is less than 1,000 feet from the nearest school, the Colorado Rocky Mountain School, according to town staff. The CMED building is 561 feet from the school's property line.
According to a memo from Town Clerk Cathy Derby, the CMED facility existed prior to July 1, 2010, when the town enacted a moratorium on new dispensaries.
As a result, Derby ruled, the CMED facility is "grandfathered" as a nonconforming use in its current location.
The CMED application is one of several that have come before the town since Carbondale's moratorium expired on July 12 and the town enacted specific rules and regulations for licensing such facilities.
In a memo to Mayor Stacey Bernot and the trustees, Police Chief Gene Schilling reported that his officers have had "no contacts with this facility other than in July in reference to this facility operating without a license."
Town staff did not recommend either denial or approval of the permit for CMED.
In other action, the trustees are scheduled to discuss a request for $7,500 to initiate a study to improve bicycle and pedestrian safety at Highway 133 and Highway 82, related to the Red Hill Recreation Area; a liquor license for the Celticfest/Octoberfest, Oct. 5-6; and a request for $7,500 for street repairs in the River Valley Ranch subdivision.
The board of trustees meeting begins at 6 p.m. at Town Hall, 511 Colorado Ave., and the public is invited to attend.
