PHOENIX, AZ -- The owner of a Phoenix cannabis club has asked for a speedy hearing on his club's legality under Arizona's medical marijuana law.
Al Sobel's club charges fees to provide patients with pot.
Last week, Arizona Attorney General Tom Horne asked a judge to shut down the cannabis clubs, claiming they violate the Arizona Medical Marijuana Act.
In filing a motion for an expedited hearing, Sobel said, "The attorney general's office has not established any evidence whatsoever that shows the 2011 Club is in violation of the law. In lieu of a summary judgment, expedite the hearing so we can get this thing resolved."
Sobel said if Horne can show he's breaking the law, he'll close his doors.
"The burden of proof now rests with him... The attorney general's failed to produce any evidence that shows the club is in violation of Arizona laws."
Arizona voters approved medical marijuana in 2009, but some parts of the law are in limbo, awaiting legal rulings. Patients are being allowed to apply for medical marijuana cards and are allowed to grow up to 12 plants for personal use.
