Always ready to invade your bedroom, the California State Legislature is pushing thru a bill that will now prevent you from buying Job Insurance. They want to ban the production of drug testing aids that people use to insure that they will pass the most demeaning test there is.
People who have never done drugs fail these tests, in fact the Mayo Clinic concluded that the EMIT test (the standard in the industry) has a 15% false-positive failure rate. That means that 15 out of every one hundred test results that should have tested negative, actually tested positive. Because of this high failure rate fifteen out of every 100 people that take this test risk losing their jobs. Think about it for a minute, would you bet your livelihood on those kind of odds?
Now California wants to make it a crime to buy job insurance. What will they think of next? Cops policing the local health food store to make sure they don't sell any pee-test-defeating herbs? Maybe they will march thru all the GNCs in the malls and destroy all the drug test aids they sell there. When will it end??? It is our job to put an end to this bill.
Call, write, email or fax your representative and tell him/her to vote no on AB 154, and tell them why. This last part is very important. For more information see the links below. Also below is the entire text of the bill.
BILL NUMBER: AB 154 INTRODUCED BILL TEXT
INTRODUCED BY Assembly Member Runner
JANUARY 31, 2001
An act to add Section 132.1 to the Penal Code, relating to crimes.
LEGISLATIVE COUNSEL'S DIGEST
AB 154, as introduced, Runner. Drug testing: manufacturing substance that produces false negative.
Existing law provides for drug testing, as specified.
This bill would provide that any person who knowingly manufactures, compounds, converts, produces, derives, processes, or prepares any substance which when added to a drug test sample produces a falsely negative result is guilty of a misdemeanor or a felony. By creating a new crime, this bill would impose a state-mandated local program upon local governments.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement is required by this act for a specified reason.
Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 132.1 is added to the Penal Code, to read:
132.1. Any person who knowingly manufactures, compounds, converts, produces, derives, processes, or prepares any substance which when added to a drug test sample produces a falsely negative result is guilty of a misdemeanor or a felony.
SEC. 2. No reimbursement is required by this act pursuant to Section 6 of Article XIIIB of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIIIB of the California Constitution.
