Continuing the ban on medical marijuana dispensaries — and a possible prohibition on all medical marijuana cultivation in Fairfield — will go before city planning commissioners when they meet Wednesday.
A new state law requires cities to have ordinances in effect by March 1 to prohibit or regulate cultivation and delivery of medical marijuana or only the state can license and regulate the drug, a staff report notes.
The law also requires cities that want to ban delivery of medical marijuana to expressly prohibit the activity, according to the staff report.
Concerns about medical marijuana cultivation arose during discussions the past two weeks involving the Police Department, city attorney's office and city manager's office, the staff report said. The alternative proposal for a complete ban on cultivation arose, the report states.
Fairfield could later amend the ban to allow noncommercial cultivation by qualified patients and their caregivers, the report adds.
Prohibition of commercial deliveries is intended to prevent crime since drivers are targets for armed robbery and some drivers carry weapons to protect themselves, according to the city.
Fairfield planning commissioners meet at 6 p.m. in the council chamber at 1000 Webster St.
The Vacaville City Council takes up the same issues Tuesday. The Suisun City Council and the Solano County Board of Supervisors took action last week.
