Out of an estimated original 100 medical marijuana dispensaries in San Jose, the city estimates that 24 are still trying to meet San Jose's new laws regulating the industry.

The City council has approved a plan to extend the date the regulations will take effect from July 17th to December 18th.

Assistant City manager Angelique Gaeta says there won't necessarily be 24 pot clubs left by December.

Milestones in September and November will help collectives plan for deadlines for getting permits and licenses, as well as give them more time to find a legal site.

The new law limits dispensaries to less than 1 percent of city land, mostly in industrial areas. Dispensaries call this a de facto ban and have launched an initiative to replace the city's ordinance with a less restrictive set of regulations.

San Jose resident Mark Metglin says one of the other tough rules has to do with surveillance, giving the large amount of digital storage it would require.

The council has also approved a rule change to allow cameras to run on motion sensors to conserve memory.

They have also approved staff research the creation of a new city division to regulate marijuana dispensaries.

An attorney is suing the city over the new regulations on behalf of San Jose Organics, a marijuana collective on Tully Road.
