At its Tuesday meeting, the City Council is scheduled to discuss results of a local survey on marijuana in the post-Proposition 64 era, and make a few adjustments to local marijuana-related laws.
On April 3, the city began an online outreach survey seeking residents' input on the implementation of Proposition 64 in Walnut Creek. Sixty-one percent of Walnut Creek voters last November said "yes" to Prop. 64, which legalizes the recreational use of marijuana by adults.
More than 1,500 people responded to Walnut Creek's survey. Among the more notable findings:
* Concerning whether commercial marijuana cultivation should be banned in Walnut Creek, 51 percent said "yes," 49 percent "no."
* Among those who said they favor commercial marijuana cultivation, 68 percent favored allowing it both indoors and outdoors.
* Sixty percent said the city should not ban stores that sell only marijuana and related
products.
* Exactly half of poll respondents said such stores should be restricted to certain parts of town.
In addition, city officials led three public outreach meetings about marijuana and Prop. 64, which also allows individuals to grow as many as six plants inside their homes. Cities have considerable leeway in regulating growing and selling marijuana, and responses to the poll and the meetings are expected to help inform how Walnut Creek leaders make policy regarding recreational marijuana in the city.
In a related action, the council on Tuesday night will consider extending for another 22 months and 15 days a citywide moratorium on any commercial activity, or outdoor cultivation of, recreational marijuana at private homes within the city. It was first adopted April 5 to help give the city time to sort through the various vagaries of Prop. 64; an extension would make commercial activity involving recreational pot, or growing any pot outdoors, illegal in the city through March 31, 2019.
And finally, also in response to Prop. 64, the council is expected to add marijuana smoke to the city's 2014 ordinance defining where cigarette smoking is permitted. It is illegal in enclosed common areas and units of apartment buildings and condos, within the city's Pedestrian Retail District (essentially, downtown) and outdoor recreational areas. This action was supported by 80 percent of respondents to the city's online marijuana survey.
A study session concentrating on the survey begins at 4 p.m. Tuesday on City Hall's third floor. The regular council meeting starts at 6 p.m. in the first-floor council chamber.
