The Boston Zoning Board of Appeals has given conditional approval to open a medical marijuana dispensary on Milk Street.
The city finally offered a conditional approval during a hearing on Aug. 4. The hearing on the request, submitted by Patriot Care Corp., had been delayed twice before in June and again in July.
The facility must be maintained as a medical marijuana facility. Patriot Care has also offered to donate the front access to the ground floor to a yet-to-be-determined non-profit.
"This sends a message across the state that the medical marijuana group can be integrated into the community helpfully, and that it's a compassionate medical service," said Nicole Snow, executive director of the Massachusetts Patient Advocacy Alliance. "I'm glad to see that the city of Boston has taken the initiative."
Patriot Care has been seeking to open a medical marijuana facility in downtown Boston since August 2013. The facility plans to have its cultivation center in Lowell, and run dispensaries out of Boston, Greenfield and Lowell.
The company's Boston and Greenfield locations were given provisional approval from the Department of Public Health in November, after its Lowell location was approved in June 2014.
Despite state approval, the applicant has struggled gaining sign off from the city. During a June hearing, attorney Michael Ross with Prince Lobel said the applicant was in the process of bringing all of its neighbors on board with the idea.
Even then, members of the Downtown Business Improvement District, a private nonprofit corporation, had voted to oppose the location.
In a statement, BID Chairman John Spurr, president of A.W. Perry, said the group opposed the location because of concerns that residents and property owners had.
"We will continue to reach out to members of the Downtown Boston community to hear and share their concerns," Spurr said in a statement in June. "This discussion is not about the legalization of marijuana, it is about finding a suitable location for a medical marijuana dispensary that meets the guidelines set forth by the Department of Public Health and the Boston Health Commission for those in need."
Members of the Downtown Business Improvement District were not immediately available for comment following the approval.
